The Digital DJ Pool (“Digital DJ Pool”, “We”, “Us”, “Our”) is an online music subscription service (“Service”, as defined in the Terms and Conditions). Through our website, digitaldjpool.com (the “Site”), members, visitors and contributors may be requested to provide certain personal information. The purpose of this privacy policy (“Privacy Policy”) is to inform you about the information we collect, how we use, maintain, protect and disclose that information, and the ways in which you can manage and control the use of your information. 1.1 Registration Data

When you register, we ask you to provide certain information, which includes your email address, username and password for your account (the “Registration Data”). We may also collect information you voluntarily add to your profile, such as your profile picture, hometown, biography, resume, label information, deejaying background and usernames for other social media accounts.

1.2 Payment Information

If you choose to subscribe to the Service, you will be asked to provide your name, email address, payment information and zip code. Such information will be provided by you directly to the third party merchant site, PayPal or Braintree. You may be subject to the privacy policy of such site. Digital DJ Pool does not store your payment information.

1.3 Information You Choose to Provide to Digital DJ Pool

When you use the Service, we automatically collect certain information, including, without limitation: (i) information about your type of Membership (as defined in the Terms); (ii) your interactions with the Service, including with songs, music crates, other Digital DJ Pool users, and advertisements which are offered, linked to or made available on the Site; and (iii) the details of the queries you make; (iv) User Content (as defined in the Terms).

1.4 Information We Collect Through Automatic Data Collection Technologies

As you navigate through and interact with the Site, we may use automatic data collection technologies to collect certain information about your equipment, browsing actions, and patterns, including:

  • Usage – Details of your visits to the Site, including pages visited, links clicked, content uploaded, downloaded or streamed, search queries, traffic data, location data, log data, and other communication data and the resources that you access and use on the Site.
  • Connection and Device – Information about devices and internet connection used to access the Site, including your connection type, device identifiers, Internet Protocol (“IP”) address, operating system, browser type, browser or device language, and crash data.
  • Cookies are used to provide functionality and to recognize you across the Site. You may refuse to accept browser cookies by activating the appropriate setting on your browser. However, if you select this setting you may be unable to access certain parts of the Site. Unless you have adjusted your browser setting so that it will refuse cookies, cookies will be issued to direct your browser to the Site.

Digital DJ Pool is the sole owner of information collected on the Site. We reserve the right to screen, copy, transmit, and review all communications conducted by or through the Site. We may conduct these activities for technical support purposes and in order to enforce our Terms and policies. At our sole discretion, we may decide to conduct these activities at various times or not at all.

1.5 Information Collected by Third Parties

When you use the Service, certain third parties may use automatic information collection technologies to collect information about you or your device. These third parties may include, but are not limited to: advertisers, ad networks, and ad servers; analytics companies; your mobile device manufacturer; your mobile service provider.

We do not control these third parties' tracking technologies or how they may be used. If you have any questions about an advertisement or other targeted content, you should contact the responsible provider directly.

These third parties may use tracking technologies to collect information about you when you use the Service. The information they collect may be associated with your personal information or they may collect information, including personal information, about your online activities over time and across different websites, apps, and other online services websites. They may use this information to provide you with interest-based (behavioral) advertising or other targeted content.

You understand and agree that third parties’ use of information they collect from you is governed by their privacy policies, and Digital DJ Pool’s use of such information is governed by this Privacy Policy.

In addition, Digital DJ Pool may receive certain information collected by third parties, such as when third parties conduct background checks or verify user profiles. Those third parties may share the results of the background check or verification with Digital DJ Pool.

1.6 Listening and Downloading Activity

When you use the Service, we keep track of your listening and downloading activity, which may include the number and title of songs you have listened to or downloaded, the songs that you flag, like (thumb up), or dislike (thumb down), and the crates you create.

1.7 Community Posting

You have the ability to post comments on songs and to post information in community networking features accessible through the Service, such as your public profile. The copyright and any intellectual property rights thereof to any comments or information posted on the Site or through the Service, except any prohibited comments or information described in this section, shall be transferred to Digital DJ Pool. You are prohibited from posting defamatory, libelous, infringing, or otherwise illegal or tortious content, and Digital DJ Pool is not liable for any such prohibited comments or information and shall not take ownership, intellectual property rights or responsibility for such prohibited comments or information.

1.8 Log Data

Digital DJ Pool may collect certain non-personally identifiable technical information through the use of log files and servers. Information in a log file may include your web request, Internet Protocol (“IP”) address, browser type, browser language, referring/exit pages and URLs, platform type, number of clicks, domain names, landing pages, pages viewed and the order of those pages, the amount spent on particular pages, Internet service provider, date/time stamps, MAC address, and other usage information and statistics.

For clarity, to be considered personally identifiable, there must be enough information that allows others to recognize you. Please note that just because you can identify yourself, it does not mean you are uniquely identifiable to others.

1.9 Location Information

As part of registration for the Service, you agree to provide us with and allow us to use your zip or postal code.

How We Use Information We Receive or Collect

We may use the information we collect, including your personal information, to: (i) provide, personalize, and improve your experience with the Service; (ii) ensure technical functioning of the Service, develop new services, and analyze your use of the Service, including your interaction on the Site; (iii) communicate with you for Service-related purposes, including promotional emails or messages; (iv) enable and promote the Service, including features and content of the Service, such as sharing, user interactions, notifications and suggestions, and integration with third party services; (v) enforce this Privacy Policy, the Terms; and (vi) as otherwise stated in this Privacy Policy.

3.1 User Content

Any personal information, images, audio content or video content that you voluntarily disclose online (on your profile page, via messages, comments or otherwise) or allow us to record and disclose (in messages or otherwise) becomes publicly available and can be collected, seen and used by others besides us. Digital DJ Pool cannot be and is not responsible for any unauthorized third party use of such information.

3.2 Email Address

We do not use your email address or other personally identifiable information to send commercial or marketing messages without your consent or except as part of a specific program or feature for which you have the ability to opt-in or out. If you would like to change your email settings or opt-out of receiving emails, you may do so by logging into your account and changing your settings under the “Settings” tab.

If you send us emails, you should be aware that information disclosed in emails may not be secure or encrypted and thus may be available to others. We suggest that you exercise caution when deciding to disclose any personal or confidential information in emails. We will use your email address to respond directly to your questions or comments.

3.3 Service Providers and Others

We may contract or partner with third parties to provide specialized services on our behalf, such as credit card processors, customer support, advertisement servers, and bulk email processors. These companies are authorized to use your personal information only as necessary to provide these services to Digital DJ Pool. They are not authorized to use your personal information for their own, unrelated purposes.

3.4 Other Sharing

In addition to the above, we may also share your information to third parties to (i) allow a merger, acquisition, or sale of all or a portion of our assets; (ii) to respond to legal process, if we have good faith belief that it is necessary to do so; to comply with requirements of mandatory applicable law; to protect the safety of any person; to protect the rights and property of Digital DJ Pool, including to enforce the Terms; and to address fraud, security or technical issues; and (iii) to inform business partners about the use of the Service.

How We Secure Your Information

We use commercially reasonable and generally-accepted technological safeguards to secure any information we collect about you. However, no method of transmission over the Internet or method of electronic storage is 100% secure. Thus, we cannot ensure or warrant the security of any information you transmit through the Site. It is not a guarantee that the information you provide may not be accessed, disclosed, altered or destroyed by breach of any of our safeguards.

Digital DJ Pool operates in the United States. As a result, your personal data will be processed by us in the United States where data protection and privacy regulations may not offer the same level of protection as in other parts of the world, such as the European Union. If you access this Site, you agree to this Privacy Policy and you consent to the transfer of any and all information you provide to us in the United States.

We will retain your information for as long as your account is active or as needed to provide you services. If you wish to cancel your account or request that we no longer use your information to provide you services, you may log into the Site and cancel your account in the “Billing” tab. Children Under the Age of 13

The Site is not intended for or direct to children under 13 years of age. No one under age 13 may provide any personal information to or on the Site. We do not knowingly collect personal information from children under 13. If you are under 13, do not use or provide any information to or on the Site or provide any information about yourself to us, including your name, address, telephone number, email address, or any user name you may use. If we learn that we have collected or received personal information from a child under 13, we will delete that information and terminate the account.

If you are visiting the Site or using the Services from outside the United States, please be aware that your information may be transferred to, stored, and processed in the United States where Digital DJ Pool’s servers are located and Digital DJ Pool’s central database is operated. By using the Site or Service, you understand that your information may be transferred to Digital DJ Pool’s facilities and those third parties with whom Digital DJ Pool shares it as described in this Privacy Policy. Your Preferences

Conflict Resolution

We are committed to resolving disputes as soon as feasible and shall endeavor to resolve all disputes brought to our attention at digitaldjpool.com/home/contact in a prompt manner in accordance with the Terms. Digital DJ Pool reserves the right to make the final determination of whether a violation of its privacy guidelines has occurred.

Legal Disclosure

This Privacy Notice for California Residents (“Privacy Notice”) supplements the information contained in our Privacy Policy above and applies solely to all users of the Site, who reside in the State of California (“consumers” or “you”). Your Rights and Choices

The CCPA provides consumers (California residents) with specific rights regarding their personal information. This section describes your CCPA rights and explains how to exercise those rights.

3.1 Access to Specific Information and Data Portability Rights

You have the right to request that we disclose certain information to you about our collection and use of your personal information over the past 12 months. Once we receive and confirm your verifiable consumer request (as further defined below in Exercising Access, Data Portability, and Deletion Rights), we will disclose to you:

3.3 Exercising Access, Data Portability, and Deletion Rights

To exercise the access, data portability, and deletion rights described above, please submit a verifiable consumer request to us at digitaldjpool.com/home/contact. Only you, or someone legally authorized to act on your behalf, may make a verifiable consumer request related to your personal information. You may also make a verifiable consumer request on behalf of your minor child.

You may only make a verifiable consumer request for access or data portability twice within a 12-month period. The “verifiable consumer request” must:

  • Provide sufficient information that allows us to reasonably verify you are the person about whom we collected personal information or an authorized representative.
  • Describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.

We cannot respond to your request or provide you with personal information if we cannot verify your identity or authority to make the request and confirm the personal information relates to you. We will only use personal information provided in a verifiable consumer request to verify the requestor’s identity or authority to make the request.

Response Timing and Format

We endeavor to respond to a verifiable consumer request within 90 days of its receipt.

Any disclosures we provide will only cover the 12-month period preceding the verifiable consumer request’s receipt. The response we provide will also explain the reasons we cannot comply with a request, if applicable. For data portability requests, we will select a format to provide your personal information that is readily useable and should allow you to transmit the information from one entity to another entity without hindrance.

We do not charge a fee to process or respond to your verifiable consumer request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.

Non-Discrimination

We will not discriminate against you for exercising any of your CCPA rights. Unless permitted by the CCPA, we will not:

  • Deny you goods or services.
  • Charge you different prices or rates for goods or services, including through granting discounts or other benefits, or imposing penalties.
  • Provide you a different level or quality of goods or services.
  • Suggest that you may receive a different price or rate for goods or services or a different level or quality of goods or services.

However, we may offer you certain financial incentives permitted by the CCPA that can result in different prices, rates, or quality levels. Any CCPA-permitted financial incentive we offer will reasonably relate to your personal information’s value and contain written terms that describe the program’s material aspects. Participation in a financial incentive program requires your prior opt in consent, which you may revoke at any time.
